Terms and conditions of use CTiContRol®
This Agreement is between you or the entity you represent and CALLTECH PROCESSING TECHNOLOGIES SA (hereinafter CALLTECH SA) and consists of the terms below, the terms incorporated by reference, the terms applicable to other Google websites and services that you use and that are necessary to use the Services (for example, your Gmail account), the Google API Terms, and the Privacy Policies. If you are accepting these Terms of Use on behalf of an entity, such as your employer, you represent that you have the legal authority to bind that entity. If you specify a company name in connection with registration or ordering a Service, you will be deemed to have placed that order and to have signed this Agreement on behalf of that organization or company. By accepting these Terms of Use, you agree to these Terms. If you do not agree to and comply with these Terms, you may not use the Services.
Services
It is a cloud solution that allows the end user to use the communications infrastructure owned directly or indirectly and that integrates with any telephone system.

CTiContRol® para Google Workforce le otorga derechos de uso sobre un conjunto de varios componentes, aplicaciones de RTC (Real Time Communications) e integración de APIs que extienden la funcionalidad de algunas aplicaciones de Google Workforce para integrar la plataforma de comunicaciones unificadas del cliente con las herramientas de colaboración de Google.
Como funciona Webphone CTiContRol®
para Google Workforce
CTiContRol® for Google Workforce incluye un Webphone para el navegador Google Chrome, que extiende las interfaces de Google Contacts y Gmail. Permitiendo al usuario registrarse con su cuenta Google Workforce al servidor de comunicaciones o softswitch, unificar la agenda de contactos directamente de Google Contacts incluyendo el directorio de extensiones corporativas y utilizar las siguientes funcionalidades telefónicas desde varias aplicaciones de Google Workforce como: recepción de llamadas, llamada en espera (Hold), transferencia y recepción de lámparas MWI.
El usuario sólo requiere instalar la extensión CTiControl® for Google Workforce de la tienda de aplicaciones Google Chrome WebStore, la cual, utiliza tecnología WebRTC para la transmisión y recepción de las comunicaciones unificadas en el navegador. A partir de ese momento siempre que se encuentre registrado en su herramienta de colaboración Google Google Workforce podrá disfrutar de todas las funcionalidades que ofrece CTiContRol® al hacer clic en la extensión habilitada en la parte superior de su navegador.
El administrador utilizará el CTiContRol® Server para configurar los servicios de voz, perfiles de usuario y consulta de reportes de uso de la plataforma.
Intellectual property rights
La aplicación CTiContRol® para Google Workforce, el software, los algoritmos y todos los derechos de propiedad intelectual de Calltech S.A., todas las patentes y solicitudes de patentes, marcas comerciales, nombres comerciales, logotipos, materiales con derechos de autor, gráficos, textos, imágenes, diseños (incluidos el “aspecto y sentir “de la aplicación y cualquier parte de ella), especificaciones, métodos, procedimientos, información, know-how, datos, datos técnicos, características interactivas, código fuente y objeto, archivos, interfaz, GUI y secretos comerciales, estén o no registrados y/o capaz de registrarse (colectivamente, “Propiedad Intelectual”), son propiedad y/o tienen licencia de Calltech S.A., y están sujetos a derechos de autor y otros derechos de propiedad intelectual aplicables según las leyes colombianas y convenciones internacionales.
How to use
The use of our services must be in accordance with the following conditions, as well as responsible use for legal, authorized and acceptable purposes.
You may not:
- Reverse engineer, decompile, disassemble or circumvent any technical limitations of the Services, except to the extent permitted by applicable law despite such limitations;
- disable, alter or attempt to circumvent any mechanism that limits your use of the Services;
- send, store or transmit a virus or other harmful computer code through or on our services;
- disrupt or interfere with the integrity or performance of our services;
- collect information about our users in any impermissible or unauthorized manner;
- rent, lease, loan, resell, transfer or sublicense any Services or any portion thereof to or for any third party, except as expressly permitted herein or in any license terms accompanying any component of the Services;
- use the Services for any purpose that is unlawful or prohibited under applicable law or these Terms and Conditions;
- or use the Services in any manner that could damage, disable, overburden, or impair any CTiContRol® for Google Workforce Service (or any networks connected to it) or interfere with any other party's use and enjoyment of any of the Services.
You are responsible for your account data and use, and you are responsible for immediately notifying us of any unauthorized use or breach of security of your account or services.
Third party services
CTiContRol® para Google Workforce permite acceder, usar o interactuar con sitios web, aplicaciones, contenido y otros productos y servicios de Google o terceros que se interactúan de forma que permite tener acceso a sus contactos, llamadas e información. tenga en cuenta que Google o Google Workforce tiene sus propias condiciones de uso y política de privacidad que regirán el uso de dichos servicios.
Updates
We may make changes to the Services from time to time, including: the availability of features.
Features. We may make features available in an updated version. Subsequent versions are provided “as is.” Subsequent versions may be subject to reduced or different security, compliance, privacy, availability, reliability, and support commitments, and other additional notices provided with the subsequent version.
Security, privacy and data
Security. We maintain technical and organizational measures, internal controls and data security routines designed to protect customer data from accidental loss or alteration, unauthorized disclosure or access, or unlawful destruction.
Data Location and Privacy. We process your data in accordance with the terms of this Privacy Policy. We may transfer, store, and process your data in Colombia or any country where we or our subcontractors maintain facilities used for the Developer Services. You will obtain any necessary consent or rights from end users or other persons whose data or personal information or other data is hosted on the Services.
Rights to Provide Data and Information. You must have, and hereby grant us, sufficient rights to use and distribute your information as necessary for us to provide you with the Services for the Application without violating the rights of any third party, and without obligating Calltech SA to you or any third party. We do not assume any additional obligations that may apply to your information except as required by applicable law.
Ownership of Data and Information. Except for the software and content we provide to you, as between the parties, you retain all rights, title and interest in and to your data. We do not acquire any rights in the data.
Use of Data and Information. The Services transmit data to us, including usage and performance data. We will use your data and information to provide our Services. This use may include troubleshooting to prevent, find, and correct problems with the operation of the Services and to ensure compliance with our Terms and Conditions. It may also include: providing you with suggestions to help you discover and use functionality within the Services, improving the features of our Services, and using patterns, trends, and other statistical data derived from your data and information to provide, operate, maintain, and improve our products and Services.
We will not use your data and information or obtain information from them for (i) advertising or (ii) other commercial purposes (other than providing the services to you) without your consent.
Deletion of data and information. Through a clear and express request, the entity with which we have a service agreement may request the deletion of data and information. Once the request has been received by this entity, we will be responsible for removing the data and information from the databases. The deletion of data and information will be eliminated between 30 and 60 days from receipt of the request. Likewise, and in the event that the company does not request a copy of the original data, we will eliminate all the data and information found in our databases.
Third Party Requests for Data and Information. We will not disclose your data to any third party except as directed by you or unless required by law. We will ask any third party requesting access to your data and information to contact you directly using your basic contact information. We will promptly notify you and provide you with a copy of the request unless legally prohibited. You are responsible for responding to any third party requests relating to your use of the Services.
Subcontractors. We may engage other companies to provide limited services on our behalf, for example, customer support. Such subcontractors will be permitted to obtain data and information only to provide the services we have engaged them to perform. We remain responsible for our subcontractors' compliance with their obligations under these terms and conditions.
Compliance with Law. We will comply with all laws applicable to our provision of the Services, including applicable laws regarding security breach notification, but excluding laws applicable to you or your industry that are not generally applicable to information technology service providers.
You will comply with all laws applicable to your data and information and use of the Services, including laws applicable to you or your industry.
Accounts and services
Account Creation. You must complete the registration process by providing us with current, complete and accurate information. You may not select an account username or identifier that impersonates another person, is or may be unlawful, or is protected by trademarks or other proprietary rights, is vulgar or offensive, or is likely to cause confusion.
Responsibility for Your Account. You are responsible for: any and all activities that occur under your account and for immediately notifying our customer support team of any potential misuse of your accounts or any security incidents related to the Services.
Validity or suspension of service
Service validity period. The validity of the service begins when you accept the terms and conditions of use, as well as the privacy policies of our services; You can opt out of these at any time through a clear and express request to the entity with which you have a service agreement. You can request the deletion of data and information. Once the request is received by this entity, we will be responsible for removing the data and information from the databases. The deletion of data and information will be eliminated between 30 and 60 days from receipt of the request. Likewise, and in the event that the company does not request a copy of the original data, we will eliminate all the data and information found in our databases.

En consideración de la compatibilidad de la suscripción a los servicios de Google como Google Contacts o Google Drive puede desde la configuración personal de su cuenta Google restringir el acceso a CTiContRol® a sus datos.
You can set up your account from https://myaccount.google.com/security, following the instructions below from your web browser, Settings / preferences / user accounts / manage Google account / security / third-party applications with account access.
Regulatory Provisions. In any country where there is any current or future government regulation or requirement that applies to us, but not generally to businesses doing business in that country, that makes it difficult for us to operate the Services without variation, or that causes us to believe that the Services may be in conflict with such regulation or requirement, we may modify the Services or discontinue providing our Services.
Suspension. We may suspend your use of the Services if:
- It is reasonably necessary to prevent unauthorized access to your data and information;
- you fail to respond to a claim of alleged infringement within a reasonable time;
- you violate these rules of use; or
- We suspect fraud. We will attempt to suspend access to the minimum necessary portion of the Services while the condition or need exists. We will notify you before we suspend unless we reasonably believe we need to suspend immediately.
RESPONSIBILITY
YOU CHOOSE TO USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES “AS IS” AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUSES OR OTHER HARMFUL CODE. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE OR SECURE, OR THAT OUR SERVICES WILL OPERATE WITHOUT INTERRUPTIONS, DELAYS OR IMPERFECTIONS. WE DO NOT CONTROL AND ARE NOT RESPONSIBLE FOR CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES OR THE FEATURES, SERVICES AND INTERFACES PROVIDED. NEITHER PARTY NOR ITS SUPPLIERS WILL BE LIABLE FOR LOSS OF REVENUE, LOST PROFITS, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
LIMITATION OF LIABILITY
CALLTECH SA WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THESE TERMS, US, OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED THE VALUE OF THREE HUNDRED THOUSAND COLOMBIAN PESOS OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER. THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE LAWS OF THIS JURISDICTION MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, AND THEREFORE, SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN OUR TERMS, IN SUCH CASES THE PARTIES' LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
YOU MAY HAVE ADDITIONAL RIGHTS UNDER LOCAL LAW THAT THESE TERMS CANNOT CHANGE. THESE DISCLAIMERS APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING APPLICATION TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Defense
You agree to defend, indemnify and hold harmless the Calltech SA Parties from and against any and all liabilities, damages, losses and expenses of any kind (including reasonable attorneys' fees and costs) relating to, arising out of or in any way connected with any of the following: (i) Your access to or use of our Services, including any information provided in connection therewith; (ii) Your breach or alleged breach of our Terms; or (iii) any misrepresentation by you. You will cooperate as fully requested by us in defending or settling any claim.
Additional provisions
No Additional Rights Granted. We reserve all rights not expressly granted under our provision of the Service, and no other rights are granted, whether by implication, estoppel, or otherwise.
Applicable legislation. The provision of our services is regulated by the legislation of the Republic of Colombia.
Force Majeure. Neither party shall be liable as a result of any failure to perform due to causes beyond its reasonable control (such as fire, explosion, power outage, earthquake, flood, storm, strike, embargo, labor dispute, act of civil or military authority, war, terrorism, including computer terrorism), acts of God, acts or omissions of Internet traffic operators, acts or omissions of governmental or regulatory bodies (including the passage of regulations or other laws of government affecting the provision of the Services).
Definitions
“Datos e información” son todos los contenidos u otros datos, incluidos los archivos de texto, sonido, vídeo o imagen y software, que usted nos proporciona, o en su nombre, o a través del uso de los servicios para desarrolladores para su uso o para uso de sus usuarios autorizados. Los datos del cliente no incluyen presentaciones ni ningún otro contenido o datos que envíe al portal de documentación o que proporcione a través de los servicios para desarrolladores para acceso público.
